Privacy Policy

At Nerd we strongly believe in data privacy and are ourselves advocates for the right to privacy. We are not just saying that in a typical company way either, as we share your same privacy concerns for our own personal lives too. After all, we all grew up with and use tech platforms in our personal time as well, when we're not designing or building your next favourite game. Privacy is important, and companies should always be responsible to protect their users and each other.

So because of this, Nerd does not collect or store any data that personally identifies an individual (such as a name, email address or billing information), or other data which can be reasonably linked to such information.

What we collect

What Nerd does track and collect is anonymised data, which our apps need to function, like Unique Device ID (UDID) which displays a collection of numbers used to identify the device (and therefore attribute performance behaviour), but it does not display the person. This information does not tell us who you are, and it is the limit of what we see when we are working on our apps.

We collect anonymised data to know what is happening in our apps, to identify performance improvements, to identify general user behaviour, and for solving technical problems. If we didn't do this, we would have no idea how our apps are performing once they are released to a wide audience. Because it's anonymised, we don't see any of your personal information. We don't even want or need it to make our games. So we just choose not to collect it.

Where applicable, before commencing play, the user consents to its user data being recorded and used by us in the way described in this privacy policy. The user's data is needed for actual technical usage and for our games to be improved.

Emails

If you send us an email, that email will remain in our inbox in order for us to keep a history of your communications with us. We do not send or use that email for anything else. It just sits there, in our inbox. We do this so that we can remember who you are if you ever contact us again, so that we can be of better assistance to you.

If you would like us to delete that email along with your email address, just email us asking to do so and we will do it, including the email you use to make the request. Please note that when we do this, we will no longer have any history of communications with you, so any queries you make afterwards will be new to us and it will be like starting over. We'll try our best to remember issues by memory though!

Advertising

Nerd uses third party services to serve advertisements within our apps. Because Nerd games are free to play, we display in-game advertising by third parties to generate revenue. That's how we can afford to make the games free.

We don't really like ads though, to be honest they don't look great on our games and we would prefer that you paid for the game, so we offer an in-app purchase in all of our games to remove and turn off all ads. We see ads as a fair exchange for allowing the app to be downloaded for free, until you decide if you like the game enough to buy it and support our game studio by doing so. We prefer that model as it allows you to try before you buy.

As we have to use ads to generate revenue for a free download, and in order to make the advertisements at least tolerable and useful to you by displaying relevant advertising (also known as interest based advertising) and in order to measure the performance of those ads, we have implemented several SDK's within the game which collect and transfer that non-sensitive device information. This information can include:

• The advertisement you have viewed and if you have engaged with it
• Device make and manufacturer
• Operating System
• Generic geographic location, such as the city you are located in
• Carrier
• Language settings
• IP Address
• Android Advertising identifier or Apple Identifier for Advertisers

We require our third party services to collect this data anonymously, in order to fit with our own values on privacy of data, and that they comply fully thanks to GDPR privacy law. These third parties utilise the data collected to track and examine the advertisements served in our apps. They use the data collected to contextualise and personalise the ads on their own advertising network.

Nerd also uses Google Analytics to improve our apps. Google Analytics is a service provided by Google. Google utilises the data collected to track and examine the use of our apps, to prepare reports on its activities, which also get shared with other Google services. Again, we have set everything we use with Google Analytics to be anonymous. You can find Google's privacy policy on their website.

Nerd is not responsible for the actions of third party people or companies, the content of their sites, the use of information you provide to them, or any products or services they may offer. Any link to those sites does not constitute our sponsorship of, or affiliation with, those people or companies.

Third-party partners

All of our third party partners have privacy policies and opt-out measures in place, including: One Signal, Google Analytics, IronSource, MoPub, Facebook Audience Network, Chartboost Ad Network, Applovin Ad Network, Tapjoy, GameAnalytics, Apple, Android, Flurry Analytics, AdColony, Vungle, Unity Ads Network, Frameplay, Firebase Analytics and AdMob, and Crashlytics, Fabric and Answers.

For Apple, follow the steps outlined on Apple's support page. For Android, navigate to the Google Settings app, select Ads, and choose to reset your Android Ad ID or opt out of personalised ads.

Why data is collected

When you install and use Nerd mobile applications, we can collect and process some of your data for different legitimate purposes. Nerd and its third-party partners collect data to provide you with the services you asked for, and to run analytics and understand how users interact with our product and services so we can improve them continuously.

The third-party partners that Nerd shares data with are: GameAnalytics, Facebook Analytics, Adjust, and Voodoo.

Data deletion requests

Data controller

The data controller is Nerd, a mobile games company incorporated in the United Kingdom and registered at Companies House under number 09152786.

Purposes of processing

Data collected by Nerd is used to:

• Provide our applications
• Guarantee use and improvement of our applications
• Develop new applications
• Understand your interests and propose targeted and relevant advertisements through SDK advertising partners
• Make statistics on your use of the games, including the number of games played, duration of use, or advertisements seen, which allows Nerd to improve your gaming experience by updating apps to improve performance and identify which parts of the game resonate the most
• Communicate with you, notably if you contact us by any means whatsoever

We collect the data listed above, in whole or in part, only once we have your express consent for the purposes for which they are to be processed, through a pop-up in our applications. At any time you can withdraw your consent from the "Settings" button in all of our applications.

Terms of data storage

Nerd stores anonymised data in their analytics and this data is stored solely for statistical use.

Categories of recipients of data collected

The recipients of the data are the teams of Nerd that need to have access, as well as the partners mentioned in this privacy policy. We may share data collected with our technical service providers for the aforementioned purposes. We stringently request that our partners always act in compliance with applicable data protection legislation and grant special attention to confidentiality of this data.

By application of the applicable regulation, any sub-contractor who may process this personal data for Nerd undertakes to: solely process data for the purpose(s) which is/are sub-contracted; process data in pursuance with Nerd's instructions; and guarantee the security and confidentiality of data.

Nerd may also disclose or transfer your personal data to third parties: by virtue of legislation, as part of legal proceedings, a dispute and/or request issued by public authorities in your country of residence or otherwise; if disclosure is necessary for national security, application of legislation, or any other matter of public interest; or in the event of restructuring, transfer, merger or sale to the third party concerned.

International data transfers

In such instance as your data is transferred outside of the European Union, we ensure that: the personal data is transferred to countries recognised as offering an equivalent level of protection; personal data is transferred via certified entities under the Privacy Shield; and for personal data transferred outside of countries recognised by the National Data Protection Authority (CNIL) as having a sufficient level of protection, any of the mechanisms offering appropriate guarantees is used, as provided for by applicable regulations, and in particular the adoption of template contractual clauses.

Children's personal data

Nerd does not knowingly collect or store any personal data concerning children under 16 years old.

Your rights

You have the following rights concerning the data that Nerd collects:

• Right to confirmation of the existence of data processing — you are entitled to obtain confirmation as to whether or not data related to you is being processed.
• Right to access your data — you are entitled to receive confirmation that your personal data is or is not processed and, when processed, to access that data, including a copy of the data processed.
• Right to request rectification of your data if incorrect — you are entitled to request that your data be amended, updated or completed when inaccurate, incorrect, incomplete or obsolete.
• Right to request deletion of your data, in particular when: it is no longer necessary for the purposes for which it was collected; you withdraw consent and there is no other legal basis for processing; you object to processing and there is no overriding legitimate ground; you consider your data has been processed illicitly; or it should be deleted to respect a legal obligation.
• Right to limit processing, in particular when: you object to the accuracy of your data; you consider processing illicit but object to deletion; or the data is still required for exercising or defending your rights in court even though Nerd no longer requires it.
• Right to object to processing by withdrawing your consent (this withdrawal does not affect the legality of processing based on consent given prior to its withdrawal).
• Right to data portability — you are entitled to reclaim your data provided to Nerd, in a structured, commonly used and machine-readable format, and to transfer it to another data controller.
• Post-mortem guidelines — you have the right to provide specific or general guidelines for the retention, erasure and disclosure of your personal data to designated third parties after your death.
• Right to complain to the National Data Protection Authority (CNIL) — if you consider that Nerd has defaulted on its obligations regarding your personal data, you may issue a complaint or claim to the competent authorities at any time.

Exercising your rights

You may exercise the rights above by emailing greetings@nerdagency.co.uk. Because of our obligation of security and confidentiality in data processing, your request will be processed subject to proof of your identity, such as a scanned copy of a valid identity document or a signed photocopy of one.

Nerd will determine whether a request is admissible within one month of receipt. Where admissible, Nerd will provide the information requested or implement the rights claimed within that deadline. If the complexity or number of requests received means the deadline cannot be met, Nerd will notify you before the deadline expires that it is being pushed back by up to two further months.

Nerd may object to requests that are clearly abusive, whether in their number, repetitive nature, or systematic character.

Data security

We take all necessary security measures to prevent, as far as practically possible, any alteration or loss of your data or any unauthorised access to it. Should we become aware of any illegal access to personal data concerning you for which we are responsible, we undertake to notify you of the incident as soon as possible where this fulfils a legal requirement.
